This privacy and data protection policy, is aimed at providing you with as much information as you need to understand the scope and purpose of data processing so that the acceptance, absolutely necessary to be able to access and use the website, is based on a perfectly informed consent collected in the Organic Law 3/2018 of 5 December on Data Protection and Guarantee of Digital Rights and in the Regulation 2016/779 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data.    

Who is responsible for the processing of your data?

The party responsible for the processing is INTERMUNDIAL XXI S.L.U., Insurance Brokerage, with tax identification number B81577231, with registered office at C/ Irún 7, 1º C, CP: 28008, registered in the Mercantile Registry of Madrid, Volume 11482, Folio 149, Section 8, Page M-180294 and in the Administrative Registry of Insurance and Reinsurance Distributors with the code J-1541. It has a civil liability insurance and financial capacity, according to current legislation. The management of the websitewww.intermundial.es, owned by INTERMUNDIAL XXI S.L.U., Correduría de Seguros (hereinafter, INTERMUNDIAL), aims to provide users with information on the company's products and services.

How do we collect your personal data? And What personal data do we collect?

The App allows users to access personal data provided directly by the user to INTERMUNDIAL, in the course of the subscription of the insurance contract, so that the user can access the same, as well as through the information provided by the user in the request for assistance service or in the communication and management of a claim through the App or through the channels described in the insurance contract subscribed.

For the provision of services and other purposes of the App, the following data may be processed:

  • Identification data: user data, telephone number.
  • Health data shared by the user and uploaded to the App.
  • Personal data descriptive of the consultation, which may include sensitive data such as: health-related data (weight, height, medical and surgical history, usual medication, allergies and vaccination), ethnic or racial origin.

This privacy policy provides specific information on the processing of data collected through the application, as well as the management carried out from the same. The Privacy Policy complements the information provided to users in relation to the processing carried out in the course of the contractual relationship.

We remind you to update your personal data when changes or modifications occur, and always provide truthful and updated information.

For what purposes do we process your personal data?

INTERMUNDIAL XXI S.L.U. processes the information provided by the interested parties in order to manage the insurance contract they have signed with us, including the processing of claims and, where appropriate, travel assistance. The use of the data is as follows:

  • To guarantee the content of the website.
  • For continuous improvement of the user experience.
  • Management and control of the contractual relationship, or in its case pre-contractual, acquired with the user through registration, request for information and/or contracting of services. 
  • For the processing of claims arising from the insurance contract subscribed. 
  • For assistance during the trip, if contracted. 
  • To inform you of any changes in our service. 
  • Control and manage the digital applications and tools developed by INTERMUNDIAL, which are necessary to provide the contracted service.
  • The use or provision of services, if any, after user registration, in accordance with the general conditions of use of the Web and the specific conditions of certain services.
  • Storage and management of queries or requests for information that may be made via e-mail.  
  • To accredit the contracting, improve the quality of the technical and commercial attention, attention to possible claims, as well as to verify customer satisfaction, through the recording of the customer's calls to the telephone numbers provided for this purpose, or those that could be made from INTERMUNDIAL or from any company authorized by the latter.
  • In the event that the user has given his/her consent, to keep him/her informed through the sending of notifications/newsletters by email and/or other electronic means on topics related to tourism and the insurance sector. In case you have contracted with us we will send you promotions and advertising of products similar to those contracted (insurance), without prejudice to the option to object at any time by sending an email to lopd@intermundial.es. 
  • For the prevention of fraud and maintenance of security, compliance with legally applicable regulations or the defense of INTERMUNDIAL's interests. 

In the case of a natural person, representative of a legal entity, self-employed or individual entrepreneur; the purpose may also include the formalization of the commercial contract with INTERMUNDIAL. 

INTERMUNDIAL reminds you that it does not store your credit card details but only the information necessary for the correct management and execution of the services contracted by the customer.

How long will we keep your data?

The data provided will be kept for the entire duration of the contract and will be blocked at the expiration of the contract.
In this way, the data will be blocked and retained for the period of limitation of actions that may arise from the contractual relationship subscribed by you. 

The data provided will be kept for the duration of the insurance contract signed, as well as for as long as you have an account with us so that we can comply with our legal, fiscal and/or accounting obligations, and the data will be cancelled upon expiry of the contract you have signed with INTERMUNDIAL. That is to say, the data will be blocked and kept during the period of prescription of the actions that could derive from the contractual relationship subscribed by you, and afterwards they will be deleted. 

In the event that you object to our processing of certain personal data (also in connection with the receipt of our marketing communications), we will keep a record of your objection to the processing of your personal data so that we can continue to respect your wishes. 

What is the legitimacy for the processing of your data?

The legal basis for the processing of your data is: 

  • Management of pre-contractual and, where appropriate, contractual measures based on Article 6.1.b) of the GDPR, as we collect and process your personal data primarily for the performance of insurance contracts according to the terms and conditions contained in such contracts. 
  • In cases where the user has contacted us requesting certain information, we may contact you again to confirm whether you need anything else with respect to that request. 
  • The possible execution of the insurance contract subscribed with INTERMUNDIAL according to the terms and conditions contained in the insurance contracted.  
  • In the case of legal entities, self-employed or individual entrepreneurs, the legal basis lies in the execution of the commercial contract.
  • Unequivocal consent based on article 6.1.a) of the RGPD, in case you are not a customer, for the sending of commercial communications, news and newsletter. 
  • We may obtain and process your personal data for our legitimate interests based on Article 6(1)(f) of the GDPR (or those of any third party). Such legitimate interests include: 
  • The offer of products and services finds its legitimacy in the legitimate interest of the data controller, the Customer may at any time express their opposition to this type of treatment without in any case the exercise of this right conditions the execution of the contract. 
  • The sending of information requested by the interested party through the sending of their data and their needs; 
  • Analyze and understand how our services are used and improve them;  
  • For the prevention of fraud or other criminal acts; or  
  • To keep our systems secure 
  • For compliance with legal obligations. 

We also inform you that failure to provide the required information will result in the impossibility of signing and fulfilling the contract. 

To which recipients will your data be communicated?

The data will not be communicated to any third party outside INTERMUNDIAL, except for legal obligation or the need to provide services related to the insurance contract contracted, upon request of the user's consent.

Depending on the purpose for which INTERMUNDIAL has collected the personal data through the website or App, the following persons may access this information without distinction:

  • Authorized personnel of data controllers subject to applicable data protection laws;
  • Official agencies or third parties in accordance with applicable legislation;
  • External service providers, with whom we have signed the legally required contracts under which they guarantee the fulfillment of their obligations as data processors and provide a service for and on behalf of INTERMUNDIAL.

The data may also be communicated to third parties in the following cases: 

  • Once you have given your consent to the distribution and/or disclosure of your data.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or to protect the rights, property, or safety of INTERMUNDIAL, our customers, or others.
  • By provision of law, regulation or by virtue of a decision of a competent authority, judicial or regulatory or, if necessary, in order to preserve their rights and interests.

Social networks

INTERMUNDIAL is present on some social networks on the Internet, and for which it acts as data controller in relation to the data published by INTERMUNDIAL. The social networks are those listed below:

INTERMUNDIAL will process the data in each social network according to the rules established for this purpose by each social network. Therefore, and unless otherwise stated, INTERMUNDIAL may inform our followers in the corresponding social network of our activities, events, and other related topics, including the attention to the follower, through the channels that the social network provides for this purpose. INTERMUNDIAL will not extract personal data from social networks, unless the user gives his express consent.

What are your rights when you provide us with your data?

Any person has the right to obtain confirmation as to whether INTERMUNDIAL is processing personal data concerning them. 

The data subject shall have the right to withdraw his or her consent at any time, provided that the processing is not necessary for the performance of the contract. The withdrawal of consent shall not affect the lawfulness of the processing based on the consent prior to its withdrawal. 

You can exercise your rights as a data subject to access, rectification, deletion, limitation, portability and opposition to the processing of personal data. You may exercise your rights at any time and free of charge by sending an e-mail to lopd@intermundial.es or by writing to Calle Irún 7, 1ºC, 28008 Madrid, indicating the right you wish to exercise and your identification data.

The data subject has the right to withdraw consent at any time, without affecting the lawfulness of the processing based on the consent prior to its withdrawal.

In addition, the data subject has the right to file a complaint with the Spanish Data Protection Agency (AEPD) as the supervisory and control authority for data protection in the Spanish territory.
